1. General information

User agreement between the user (‘User’, ‘you’) and ItaliaVacance.com. Please read these general terms and conditions carefully. We are a Dutch registered company. Our business and the services we offer are governed by the applicable laws of the Netherlands. No warranties and/or representations of any kind, express or implied, are given as to the compliance of the information shown on this Site, the services offered by or on behalf of us, any information relating to such services and our business in any respect with any laws of any other country which do not, in any event, affect or apply to the same.

You agree to be bound by the following obligations, including without limitation: You accept financial responsibility for all transactions made under your name:

• You must be 18 years of age or over and have legal capacity.
• You warrant that all information you provide about yourself or anyone else shall be true and accurate.
• The site must not be used for speculative, false or fraudulent bookings.
• The transmission of threatening, defamatory, pornographic, political, or racist material or any material that is otherwise unlawful is expressly prohibited.
• The site and any content may not be modified, copied, transmitted, distributed, sold, displayed, licensed or reproduced in any way by you, except that one copy of the information contained within the Site may be made for personal, non-commercial use.

For persons who are resident in the Netherlands or any other country of the European Union, the applicable booking conditions are those which appear on the relevant product pages and you must read these before confirming your booking. All bookings are also subject to the general information appearing in our current On-line brochure and product descriptions.

Access to this Site is conditional on your agreement that all information contained in it and all matters which arise between you and us will be governed by Dutch law. Access is further conditional on your agreement that any dispute or matter which arises between you and us will be dealt with exclusively by the Courts of the Netherlands.

2. How to book

You can book by e-mail or via our Internet site. These two ways of booking are legally binding. Every booking will be confirmed by ItaliaVacance.com by E-mail together with a invoice/confirmation. If you have not received you confirmation with 2 days, pls. contact us. Cancellation and amendment charges are payable if a booking is cancelled or amended after it has been confirmed by ItaliaVacance.com.

3. Changes or amendments

ItaliaVacance.com charges € 25,- as a processing fee, if necessary as far as changes or amendments of the reservation are demanded by customer.

4. Guarantees/Liability

No warranties, promises and/or representations of any kind, express or implied, are given as to the accuracy of any of the information contained on this Site or as to the nature, standard, suitability or otherwise of any services offered by us or on our behalf. We shall not be liable for any loss or damage of whatever nature (direct, indirect, consequential or other) which may arise as a result, directly or indirectly, from the use of any of the information or material contained in this Site and/or use of or access to any other information or material via web links from this site or any inability to access or use this Site. These exclusions of liability apply only to the extent permitted by law and, except for information or material accessed via Sites or supplied by an identified Third Party, where consistent with our applicable booking conditions. If any of these exclusions, in whole or part, is found to be unlawful, void or for any other reason unenforceable, that exclusion or part of the exclusion shall be deemed severable and shall not affect the validity or enforceability of the other exclusion(s) or part(s) of the exclusion(s) in question.

ItaliaVacance.com may change any aspect of the Site or its content, including the availability of any accommodation, features, information, database or content. Without prejudice to the foregoing provisions, we are entitled to the benefit of any applicable exclusions and/or limitations of liability permitted by the laws of any country found to be applicable to the information shown on this Site and/or any services offered by us or on our behalf.

5. Travel documents

ItaliaVacance.com will provide the customer with all the necessary travel vouchers. The customer himself is responsible for a valid passport or ID-card.

6. Arrival and departure

The minimum rental-period is 7 Nights, except the accommodations that explicitly indicate a different period. Time of arrival and departure and mentioned in you travel documents. Early arrival is you own responsibility. In case of delay, you are obliged to contact the booked accommodation immediately, if not, the accommodation will be reserved for other 24-hours only.

7. Replacements

Please note that if the number of participants that is indicated in the travel documents is not fulfilled, someone else can take his/her place as long as the travel agent has been informed accordingly.

8. Accommodation on request

Part of our accommodations is on request. This means that we contact the owner of the accommodation for the confirmation. In case that the owner can not provide the accommodation we will let you know within 2 working days. Of course we will be of assistance to help you find an alternative accommodation.

9. Complaints

Complaints resulting from a defect in the accommodation are subsequent impossibility of performance and to be reported to the owner of the property immediately. If although everything has been tried your complaint has not been solved, you may contact the office of ItaliaVacance.com, we will try to assist you if this lies in our possibilities. Within 20 days after your return you can report a written complaint only. After the period of notice expires, travel claims can not be enforced and the contractual partner cannot be made responsible.

10. Pets

In case pets are allowed on the premises you must have a written confirmation from ItaliaVacance.com. Every pet must be vaccinated and have a valid vaccination passport. Pets are not allowed in public buildings, restaurants, beaches and in the swimming pool.

11. Prices

All prices and/or discounts can be found on the websites on the online pricelist. Extra charges are always mentioned separately and are for the duration of the stay. Extra costs such as electricity, water, phone, air-co or other charges during you stay must be paid on site. Please note that in some countries for some accommodations you must pay touristtax on site, for instance in Austria, Croatia, France, Hungary and Italy.

The information and/or prices shown on this Site are updated from time to time and therefore may have changed by the time you come to book your holiday or travel arrangements. Whilst every effort is made to ensure the accuracy of all such information and prices, regrettably errors do occasionally occur. You must therefore ensure you check all details of your chosen holiday or travel arrangements (including the price) at the time of booking.

12. Insurance

We strongly advise you to take a cancellation Insurance, even if you travel in the very near future. You pay 6% of the total booking price, payable together with your first down payment, and policy charges of €5,00. Please Note! Your confirmation is also your insurance policy. Cancellation insurance has effect 6 hours after you have booked. If you want to cancel the insurance you must do this within 48 hours after the confirmation of your booking, after this it is no longer possible to cancel and you need to pay for the insurance.

13. Wheelchairs and/or handicap

Wheelchair users and handicapped persons are requested to cheque the details of the accommodation with care. So you can decide if these are suitable.

14. Heating

In case of use of the heating, the charges are mentioned per kWh or per week/day. For wood logs you can be charged extra.

15. Building activities and/or Noise

Sometimes, but very seldom building activities are close to your accommodation. We cannot accept any liability for this. Also for the noise of church bells, neighbours or farm equipment. In case of polluted water in your holiday area the local government is responsible, please get information or advise through the local media.

16. Bedlinnen/clothes

Bed clothes, towels etc. are mostly for rent at the property, in some cases it’s included in the price. On our Web-site you can see where we can book these for you, or you can organise this on site.

17. Deposit

The deposit that has to be paid on site needs to be paid on arrival. In case you make a mess or damage the property or its contents, a part or the whole deposit can be contained. Sometimes other charges on site are deducted from the deposit. ItaliaVacance.com takes no responsibility for the charges or the return of the deposit.

18. Boats

In principal you can take your boat to Lake Garda. Your boat must apply to all the regular safety standards und you must have all the necessary documents and licences. So we advise you to check beforehand if you have all the correct papers and if you boat is allowed on the water where you intend to go. ItaliaVacance.com is not liable for the boats taken by its customers.

19. Final cleaning

The charges for the final cleaning at the end of your stay are to be paid on site; in case you leave a messy accommodation part of the deposit will be deducted.

20. Pre-booking

If you would like to book for the following season? No problem, but your booking is under restriction of price and/or programme change. In principal you pay 30% of the down payment of the total booking price of €200,00 or 100% (plus booking charges €25,00) until the new prices and programme are available. You are free to cancel your booking till 30th October 2011 and get your down payment refunded. The pre-book discount is not valid for accommodations on Camping Bella Italia.

21. Payment

a) The price stipulated in the confirmation for the accommodation is to be paid fully before the commencement of travel. b) 30% of the deposit plus booking charges (and insurance) are to be paid immediately after confirmation of the booking. c) The remainder has to be paid 6 weeks before arrival. d)) prior to the holiday, the contractual party will receive all travel documents (vouchers, etc.) by e-mail. e) If a booking takes place within 10 weeks before arrival the complete booking sum must be paid in full at once. f) In case of a booking 4 weeks before arrival, the complete payment must be made by Internet banking or telephone transfer within 2 days after the confirmation, after receiving these we send all the travel documents immediately by e-mail. g) If the total booking sum is less than €250, 00 it needs to be paid in full at once. h) Every payment made to ItaliaVacance.com will be confirmed within 24 hours by e-mail. i) We must point out that if your payments are seriously overdue, we have the right to cancel your booking and make you responsible for the costs and deduct these from possible down payments.

22. Withdrawal or cancellation

Only written cancellations/withdrawals can be accepted, by registered mail addressed to: ItaliaVacance.com, Beatrixstraat 4, 7573 AA Oldenzaal, the Netherlands.
In the case that the customer cancels the booking, consequently the booking charges and the following amounts are payable to ItaliaVacance.com:
a. in case of cancellation until 42 days before the day of arrival : 30% of the total amount b. in case of cancellation from the 42nd day until the 28th day before the day of arrival: 60 % of the total amount c. in case of cancellation from the 28th day until the day before arrival: 100% of the total amount.

23. Services

Our contractual services are determined by the binding services description on the invoice/confirmation and in the travel papers and documents. Side agreements or special wishes requested by the contractual party are to be incorporated into the invoice/confirmation.

24. Special wishes

Special needs (called preferences) in respect of accommodation (bed, location, etc.) should immediately be given when booking. ItaliaVacance.com will pass on this wish to the accommodation provider and/or carrier. The implementation can not be guaranteed. Is a special wish for the client so important that the journey can not continue if it is not met, then there is an “essence”. You need make this “essence” clearly and explicitly known on the reservation. Should it appear that a request or essence can not be accepted; in that case no reservation is established. There is a fundamental difference between a substance for medical reasons and other than medical grounds.
The application fee is € 30, - for a substance for medical reasons and € 35, - for a substance other than medical reasons, even if it appears that your request or requirements can not be met.
It is also required that personal data is collected for the purpose of the trip. This provision is not only for a mental or physical disability but also other functions necessary for the implementation of the journey for the traveller or for the group. Oral agreements and/or commitments, not confirmed by ItaliaVacance.com on your booking confirmation are not valid.

25. Facilities

In the text of where we offer the accommodation facilities there can possibly be extra costs. These are usually settled on site. This does not mean that other facilities, which no charges have been published, such as tennis court use, telephone, crèche, disco, etc. are free. Indication of facilities does not ensure that they are always open. In particular, out of season it may be that certain facilities have not yet opened or already closed. In some cases these facilities are leased to third parties, so that neither ItaliaVacance.com nor the owner of the accommodation can have any influence. Occasionally this concerns a swimming pool or a supermarket on the holiday location. This also regards facilities in the area, such as supermarkets, swimming pools, attractions, tennis courts etc. ItaliaVacance.com takes great care to publish all the known information about the existence and opening periods/times of all facilities, but can not be held responsible for possible changes after updating the site. If changes are known, after the update, we will notify our customer at the reservation to notify.

26. Finally, some practical tips

The outdoors has a great appeal, but we ask customers to take into consideration the living habits of the area. People and animals in rural areas wake up early and are sometimes noisy. On the site we indicate the location of the accommodation; this says nothing about its location inside or outside the urban areas. If the house is old, spider webs and regularly cracked walls can occur. Occasionally a visit by a field-mouse, flies, mosquitoes or other animals can not be excluded. Inconvenience of these insects or small animals can often be minimized by the careful preservation of food and closed windows and doors when the lights are on. Proper insecticides are usually for sale in local shops. Mosquitoes and insects are frequently in a residence near the water. If you need a cot, high chair or playpen, if available on the spot, please indicate this at your reservation/booking. Charged are generally to be paid on site. In some accommodation wearing of a bathing cap in the pool is required. A description listed first aid post in general means that there is at least one first aid kit available. Private garages and parking spaces are not usually free. Parking is in all cases at your own risk. A double bed could mean that there are two single beds of two single mattresses next to each other. You need to provide you own hand-and kitchen towels. Occupation of your rented cottage with more than specified persons that are registered on your booking is not permitted. It is not allowed to receive visitors or have them stay overnight without the express permission of the owner/manager. If the final cleaning is not included, please take into account the holiday guest who comes after you. These would also like to arrive in a clean, tidy accommodation. If the final cleaning is included, is requested to leave the accommodation orderly and tidy (clean dishes in the cupboard).
